Buying a second-hand 3DS

[Released: 2011] The 3DS is similar to the DS, but is capable of projecting stereoscopic 3D effects without the use of 3D glasses or additional accessories. A redesigned "XL" version of the console was also released.

Buying a second-hand 3DS

I am considering buying a second-hand, modded 3DS. I have never owned a Nintendo console before, so I am new to all this stuff (especially modding). The console is modded and has 21 games. I asked the seller if I can download new games on it (I really want Animal Crossing and maybe even Minecraft) and he answered that it is possible. How can I know if it's legit? Also, would you recommend me any other questions I shoud ask him before buying it?
