Lego Star Wars The Force Awakens on 2DS

Hello,
So I bought Lego Star Wars TFA on eBay for the kiddo to play on his 2DS, and I noticed while helping him to get through a level (attack on village Jakku) at around a certain point, I think trying to load what comes next, the game keeps suddenly crashing out of gameplay and takes me to "error has occured system will restart".
It then loads the 2DS home screen and we have to load the game again and lose any progress made.
It hasn't happened while playing other parts of the game, or while playing other DS games, and I googled how to check for counterfeit DS games but everything seems to check out - any ideas?
